Stadttauben haben durch den Gesetzgeber Rechte

Der Staat hat eine Schutzpflicht für die unserer Obhut anvertrauten Tiere ( §1 TierSchG, BVerfG, Urteil vom 06.07.1999, NJW 1999, 3253, Artikel 20a GG, BT-Dr. 14/8860, dazu Kluge-v. Loeper, Tierschutzgesetz, Einführung Rn 104 e ). Der Tierschutz hat durch den Verfassungsrang des Einzeltierschutzes - laut Art. 20a GG "der Staat schützt die Tiere..." seit 2002 eine wesentliche Aufwertung erfahren, weil diese als Norm als Querschnittsklausel mit weitreichenden Folgen für das ganze Rechtssystem geschaffen wurde ( Kloepfer / Rossi JZ 1998, 369, 373 und Hirt / Maisack / Moritz, TierSchG, Art. 20 a G
