Sozialstaat

Man sollte sich gut überlegen, ob man dem Staat neue Leistungsrechte auferlegen sollte. Allerdings könnte ein solches Recht zur tatsächlichen Umsetzung des Sozialstaates beitragen und würde entsprechende Schutzpflichten des Staates klarer formulieren.

Vorsicht bei Beschränkung von Eigentümerrechten

Wohnungen befinden sich überwiegend in privater Hand. Auf ein entsprechende Grundrecht könnte der Staat überhaupt nicht leisten. Ein entsprechendes Grundrecht könnte also allenfalls mittelbar gegen Wohnungseigentümer wirken. Das bedeutet aber eine Beschränkung von deren Rechte und führt letztlich zum Risiko einer weiteren Verschärfung des Wohnungsmarktes infolge abnehmender Investitionen.

Zerstörung des Immobilienmarktes

Um unmittelbar auf ein solches Grundrecht leisten zu können, müsste der Staat selbst Wohnungen bereitstellen. Dies würde den Immobilienmarkt jedoch völlig zerstören.
