On 15.08.2017, airberlin filed for insolvency proceedings. For many employees, the situation around their own workplace is still uncertain, in some cases dismissals have already been announced. The loss of ALL jobs threatens! Support the employees: to maintain their employment and collective bargaining agreement, to continue to secure fair working conditions, if necessary to obtain a fair transitional arrangement, not to become unemployed.
There is public interest! Because there's danger that thousands of jobs will be lost or will go abroad, whereby the state treasury will be significantly burdened and hard-won collective agreements will be bypassed.
** Staff with heart **
For many years, airberlin employees have given their hearts to every passenger, their airline and their team. If the take-off and landing rights as well as machines are transferred to the buyer, the person must not be left behind. Therefore the following is required:
** Examination of a transfer of business **
The transfer of business must be critically examined! For if the take-off and landing rights and employees closely connected with the machines are transferred to the buyer, this is more than mere evidence of a transfer of business. Then possible and already pronounced in this context dismissals are probably unlawful, since an employment relationship with the buyer would continue - to equal working conditions (!) - exist. Also, with business transfer, other contracts are well on the way, e.g. important rental agreement BER airport, contracts with service providers, etc. The consequences are far-reaching!
** Save employment contracts **
Support the preservation of contracts and conditions. After all, airberlin employees were already flying for other airlines with leased aircrafts and leased maintenance (wet lease method). Why should the employees then apply to new, worse conditions? For jobs without collective agreement, without the opportunities to work part-time (important for families!) and up to 50 percent less salary?
** Compensation for expired flight tickets **
This may affect up to 200,000 flight tickets and more that have lost their validity.
** Eliminate existential fears **
There are existential fears among the employees followed by sleepless nights! For what if the insolvency estate is insufficient to pay the salaries within the notice period after the insolvency is opened? Therefore create security and clarity for the workforce.
** Moral support **
Many passengers were fans of airberlin and its staff. Show your support and sympathy with your signature.
