Ein "positives Weisungsrecht" in dem Sinne, dass die staatsanwältliche Verfolgung einer Tat von einer außenstehenden Person (nicht aus der Justiz) angeordnet werden kann, nicht aber das Unterlassen einer solchen juristischen Verfolgung, könnte durchaus notwendig sein. Es darf allerdings niemand das Recht haben, einem Staatsanwalt zu untersagen, eine Klage anzustreben.
